BAY NATURE EVENT RELEASE OF LIABILITY

In consideration of being permitted to participate in a Bay Nature sponsored event, I for myself, my personal representatives, heirs, and assigns, agree as follows:

ASSUMPTION OF RISK

By accepting this release of liability, I acknowledge that I have voluntarily requested to participate in this event. I understand that this event may involve hazards and unknown risks, including, but not limited to, trail conditions, weather, or other natural or artificial hazards. I fully assume all risks of participating in the event.

RELEASE OF LIABILITY

I hereby release, discharge, covenant not to sue, and agree to indemnify, save and hold harmless Bay Nature, its respective officials, volunteers, administrators, agents, and employees (each considered one of the "Releasees" herein) from all liability, claims, demands, losses, or damages for personal injury, death, property damage, or other risks which I may incur as a result of participating in the event caused or alleged to be caused in whole or in part by the negligence of the "Releasees", including, but not limited to, negligent rescue operations. I fully understand that the event may involve risks and dangers of serious bodily injury, including permanent disability, paralysis and death. These risks and dangers may be caused by my own actions, or inactions, the actions or inactions of others participating in the event, the conditions in which the event takes place, or the negligence of the "Releasees". There may be other risks and social and economic losses either not known to me or not readily foreseeable at this time; and I fully accept and fully assume all such risks and all responsibility for losses, costs and damages I incur as a result of my participation in the event.

TRAIL CONDITIONS

Some common conditions you may encounter on the trail include, but are not limited to, the presence of poison oak, ticks, rattlesnakes, wildlife, and trail users. Some trails are wide and smooth, while others may be steep, narrow, muddy, overgrown, rutted, in remote locations, and/or have natural or man-made hazards, such as fallen trees and drainage structures.

PHOTOGRAPHIC RELEASE

I understand that Bay Nature may use my photograph for Bay Nature publications, presentations and/or media related purposes.

I HAVE CAREFULLY READ THIS AGREEMENT. I FULLY UNDERSTAND ITS TERMS. I UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY ACCEPTING IT AND HAVE ACCEPTED IT FREELY AND WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE. I INTEND THIS AGREEMENT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID, THE BALANCE, NOT WITHSTANDING, SHALL CONTINUE IN FULL EFFECT.

IF PARTICIPANT IN THIS EVENT IS A MINOR (UNDER THE AGE OF 18 ON THE DATE OF THE EVENT) THEN THIS AGREEMENT MUST BE ACCEPTED BY A PARENT OR LEGAL GUARDIAN.
